I use to be a nanny and the woman JUST told me she is claiming me on her taxes. Am I going to get audited?


I nannied for her kid for about 6 months, and anytime I asked her if she was going to be claiming me on her taxes, or how we go about doing that, she'd say "we will discuss it later"...and never did. I moved away and I got a phone call the other day from her saying "by the way, we went ahead and claimed you on our taxes, thanks!"
SO I called her back and told her that we got our return a month ago, and she said "thats okay". And now wont talk to me about it. What could she have claimed me as if I never filled out a W2? She does have my SSN.
I have no idea what to do or what is going to happen now. It was a part time thing, only a few hours a week...basically like babysitting.
HELP?!?!! How do I fix this mess? (or is it even a mess?) Any ideas?

What's going to happen is that you are going to have to file an amended return claiming the income and paying the tax on it - if you don't, you'll be getting a bill from the IRS for the additional tax, plus interest and penalties. It was taxable income to you whether she claimed it or not.

But there's another wrinkle here. If you were working in their home, they were required to treat you as a household employee, withhold tax and pay the employer taxes on what they paid you - and it doesn't sound like they did that. You can file a form SS-8 and ask for a determination of status, and she will most likely end up paying half of the social security and medicare tax that otherwise you'll get stuck with.

It depends on how much you earned, but generally you would need to file an amended return, reporting the income you received. Your SSN is now in the system as having received the income.

call the irs and tell them the situation. you dont have to give your name and then at least you know what the worst case scenario would be.
She was very presumptious and I think she would be more inthe wrong than you.

Claimed you as a dependent?

Claimed you as a household employee?

You got what return? Do you mean you filed a tax return and goat a refund?

File an amended return, 1040X and claim that income.

I dont know how she clamed you. but i would definatly talk to a tax specialist and find out how she could have claimed you and if she did she will be the one to get into trouble and not you. best of luck to you

Find out from her exactly what she said she paid for you. She sounds manipulative, so make sure she didn't put that she paid you more than she actually did. Then you probably have to file an ammended return.

Edit: It's good that she paid in personal cheques. That way the bank will have a record of how much those cheques are for and she won't be able to claim a greater amount. That's why I'm worried for you: she brushes you off, won't talk about it, then claims at the last minute? It seems like she has something up her sleave. At the very least she is an inconsiderate person. Anyway, just try to fix this and if she ever asks you to look after her kids again say no! :)

Edit2: she is likely claiming you under child care expenses, not as a dependent. That is why you have to fix it on your end.

Contact the IRS. This woman cannot claim you as a dependent because you are not a qualified dependent of hers. There are certain trests a person has to meet to be a dependent of someone else, one of which is some sort of blood relationship (son or daughter, cousin, nephew, grandchild, that sort of thing).

Simply turn the matter over to the IRS. Call them and speak to someone and explain the situation. They will tell you what to do. The mess will be totally on this woman, since she is wrong is claiming you as a dependent.
