Will I recieve my childs father's tax refund and stimulus payment? |
I live in Illinois. My childs father lives in another state. The child support order began in November of 07 and is automatically deducted for both the arrears and the current amounts. I JUST GOT MY EX'S FEDERAL REFUND B/C HE'S IN ARREARS.I GOT IT TUESDAY IN MY BANK ACCOUNT.I HAVE A ORDER WITH CHILD SUPPORT ENFORCEMENT AND ASKED THEM TO PUT A LIEN ON HIS TAXES AND THEY DID ITHINK THEY DO IT AUTOMATICALLY THOUGH.SO IF U HAVE A ORDER AND HE'S IN ARREARS THEY SHOULD TAKE HIS CHECK.I'M ALSO EXPECTING HIS REBATE TOO AND U WILL GET THAT TOO IF HE STILL OWES.IF U HAVE HIS SS# CALL THIS # THE FEDERAL OFFSET PROGRAM AT 1-800-304-3107 IT'S AN AUTOMATIC MESSAGE ENTER HIS SOCIAL AND IT WILL TELL U IF HIS REFUND WILL BE OFFSET IF IT HASN'T ALREADY AND IF IT HAVE THEY WILL SAY FOR HOW MUCH AND PROVIDE THE PHONE NUMBER TO REQUESTED IT TO BE OFFSET,OR IF HE HAS A DEBT AND IT WASN'T TAKEN YET THEY WILL NOT SAY THE AMOUNT ,THEY WILL JUST SAY HE HAS A DEBT.WHEN IT DOES GET OFFSET IT WILL PROBALY TAKE 4 WEEKS TO GET TO U.THAT'S HOW LONG IT TOOK FOR ME.I DON'T KNOW YOUR WHOLE SITUATION SO I CAN'T REALLY SAY HOW LONG FOR SURE.HOPE THIS HELPED WITH THE QUESTIONS U HAD.GOOD LUCK! your question is not specific enough to answer. From whom (what entity) do you get the arrears and current? His paycheck? Has he agreed to this, a mutually agreed support agreement filed with the court and signed by the judge, or do you have a blanket judgment? If an open judgment, then contact the IRS Legally you should but unless the IRS has a court order on file and tags his return, I don't know if it will get sent to you as it should. If the arrears are for money ordered after the fact for time earlier than the court order, then probably not. If there was an order in place and he didn't pay what he was required to, then probably yes. |
