My Employer falsified my W-2, now wants to change it to a 1099?


Employer gave me paychecks all year with just net amounts, didn't show tax withheld. Furnished W2 with all tax info on it. Now, April 16, says he's sending me a 1099 instead. What dept. of the IRS can I approach to handle this? This is serious!

What's important is: What DEPT. of the IRS to contact? How to reach the problem resolution office? How to report fraud...Need a department where I can put all this in writing, to document my contacting IRS before they come after me!

Get form SS-8. Fill it out. File with the W-2 and keep the SS-8 ready to go.

The fact that he ALREADY gave you a W-2 weighs against him. He's probably just now discovered he never sent your withholdings and payroll tax in and he owes a HUGE penalty.

This is serious. Your employer is cheating several gov't agencies out of the tax money he was supposed to be witholding.

Refuse to take the 1099, unless he hands over all the taxes he was supposed to be paying to the gov't, to you, because you will be getting the tax bill for them otherwise.

If that doesn't work out, here's the toll free number to the IRS 1-800-829-1040 to report this to. You should also look up the State income tax agencies number if you have one and report there too.

UPDATE: Call the number. Tell them you believe your employer maybe committing tax fraud. Let the person on the other end of the phone tell you how to proceed. That's their job.

File your taxes with the W2 and report your employer.
