Can I claim my husband and my new son on my income taxes this year?


I got married in july of this year and I had a son this month and I was wondering if I can claim them both.

You can file a joint return with your husband and claim your son as the third exemption and get a $1,000 child credit for him. You will need to apply for a social security number for your son as soon as possible.

You don't claim a husband, you file jointly. If the child was born in Dec, it counts as having been alive all year for tax purposes. If your husband doesn't work, you still have to file a joint return or file married filing seperately. DO NOT file as both single, or single/head of household, this would be fraud and can get you in lots of trouble. See a professional if you have no idea what you are doing.

A baby born at 11:59 PM on Dec 31, 2007 can be claimed as a deduction for the whole year of 2007. So your baby is counts. I think you would have to prove that you provide for at least 50% of your husbands support to claim him as a deduction. You can find that in the 1040 instructions or on the IRS site. Be sure before you file.

Yes, you are married and you had your son as of Dec 31, 2007. So you can file jointly with him or married filing separately. If you file separately only one of you can claim your son. But it would just be easier doing them jointly. Congratz on the marriage and the new baby!
