Help The 1040 form 2441 is not delayed.?

The 1040 form 2441 is not delayed. The 1040A schedule 2 is. These are both the same credit (child and dependant care), so it is bizarre that one form is encoded and the other isn't....

i usually file through tax brain and it generates the 1040a , what is the difference between the two forms

Do you mean what is the difference between 1040 and 1040A? The 1040 has more lines to list more information. The 1040A is a simpler form of the 1040.

Although you may qualify to use Form 1040A, you are not required to use that form. Anyone may choose to use Form 1040.

If you are receiving the Dependent Care Credit, file Form 1040 and attach Form 2441, rather than file Form 1040A. There should be no delay in processing your return (assuming you do not owe AMT).

If you file Form 1040A and use Schedule 2, the IRS will not process that return before February 11 due to last minute changes in the tax laws.

Form 2441 will not be available for electronic filing until after Feb 11th. Or, that is the projection at this time.

This form is affected by the Alternative Minimum Tax, which was changed a few days ago by Congress. The IRS has been forced to 'scramble' their staff to fix the issues in the software, and this form is one of the ones affected. I don't know where you got your information about the 2441 not being delayed - IRS says it will be.

The difference between the two forms is whether or not you can file a 1040A. If there is a reason you have to file a 1040, you will have to use the 2441. The 1040 would also be required if you 'hit' the AMT. Be careful using any software product now, because the patch and updates for the AMT might not yet be included. Everyone was prepared for the possibility, but nobody could actually change software until Congress actually passed the 'fix' for AMT.

Not an easy thing for the average taxpayer to understand - this is one of the most common questions this year.
