Maternity pay for temporary workers?


I am SO stuck...I am currently 17 weeks and due to give birth on the 20th of September. I am a temporary worker, am I entitled to Maternity Pay? I pay NI and tax weekly. I read something about temporary workers being entitled to Maternity Pay as long as they have been with the agency for 26 weeks in the 15th week before the baby is due. I also read that I would or should be entitled to 90% of my wages for 6 weeks and 拢117 a week for the next 26 weeks.
Help I am so confused!

What you have written is correct - if you have been working for the agency for 6 months prior to week 25 (early June) then you should get Statutory Maternity Pay at the rates you quoted. If not you should investigate a benefit called Maternity Allowance.

Only employee under the contract of service is entiltle to maternity pay.
Look at the term of your employment with the agency, you can find it in your contract with the agency, whether the contract specifies that you are under a contract for service or contract of service. If you are under a contract for service, it means that you are not an employee of the agency and are self-employed. If you are under a contract of service, then you are an employee of the agency.
However, the term is not conclusive, as you are paying NI and tax weekly, there is a presumption that you are in an employment relationship with your agency and may entitle you to the employee's right to maternity pay. Also, are you under the control of the agency which tells you when and where to work, whether the agency is obliged to provide you with work? If so, these may be strong presumptions that you are an employee of the agency as well.

yep, i worked full time for a temp agency and they paid me maternity pay.
