My boyfriend messed up our taxes?


I was supposed to claim our son as a dependant as usual and I had them filed around March 20th (an accounting agency did my taxes through e-file). I have been wondering why my refund has not been deposited yet, so I called the IRS and they said my refund was denied because someone else claimed my son. Turns out, my boyfriend claimed him as a dependant and didn't know it (he is a dumbass!!) I called the accounting place and told them, and they said they would try to refile them and so I automatically get a 2 day extention without penalty, but I know it is going to get rejected again because it won't be fixed in time. My boyfriend got his refund about a month ago, and now we are filing a new form to make changes so I can claim him as planned. (He only got 1300 back, if I claim him we get 4k) So my question is, will I get penalized for doing this late? And should the accounting agency or the IRS have contacted me to let me know they were rejected BEFORE it was to late? They just rejected

my return and expected me to be a psyhcic.

all this has a solution.

not a big deal to the irs if you dont owe any additional taxes.

only you boyfriend will have an issue in that he will have to pay back any tax he owes.

just go to your friendly local tax preparer to do all the required paperwork...or do it yourself if you want...its not too difficult.

The people who filed your tax in the first place would have been notified that they were rejected, and should have contacted you then if they were even halfway competent.

Your bf will have to file an amended return dropping his claim to the exemption.

You will never be penalized for filing late when you are owed a refund. File whenever you like.

You may need to prove that your dependent son is yours and not your boyfriend's. Someone may go down on fraud charges here!

1. Your tax preparer should have known to tell you to file a paper return and simultaneously ask your boyfriend to amend his to remove the duplicate.

2. As long as you keep efiling it, it will be rejected. There is no way to scrub it out of the efile database. The service center can hit an override key.

YOU MUST TELL THE PREPARER TO STOP with the efile so you can sign and mail it. INCLUDE a copy of the rejection as proof that you had an "extra" extension.

3. Your boyfriend is the one who will pay penalties and interest as he pays the $1300 back. (If you are both eligible and can't decide, the IRS will use the AGI as the tie-breaker.) Yes, you can repay the $1300 back for him.

4. If your boyfriend doesn't live with you, he can get in big trouble if he claimed your child without the a signed 8332 form. If he asked for and got EIC, he can get banned from the program for 2 to 10 years.

Yes, you will owe money for your boyfriends "mistake." As far as the IRS is concerned, you gave them false information. There are lots of people who claim dependents when they are not eligible, so the IRS tries to keep a close watch on this type of thing. Since your bf got paid already, you are going to have to prove to the IRS that you are the one that provided the childs support, that he lived with you and that you are rightously able to claim him. They will do what is called an examination, and they will ask you to submit supporting documentation. You will have a certain amount of time to comply and if you don't, you will be audited. So after you prove to them by their standards that you are the eligible parent, you will get your refund, and your boyfriend will be penalized. He will also have to prove everything next time he tries to claim earned income credit for anyone, and you will too, since you have been denied. It's not smart to screw up with the feds, they will not let you forget it, and they will make stuff difficult if you make it difficult for them. The reason is because there are too many folks out there getting over, so everyone is subject to scrutiny. You need to slap your dude because you know all he was trying to do is get that check in his name, before you! Greed is a bad thing! And it can get you in hot water! There is a certain form (8862 I think) that you can file with your taxes to get the permission of the other parent to claim a kid that is legally in the custody of both parents equally. This will prevent your bf from pulling this stuff next year. You can make the form effective for the rest of the kids 18 years if you want. Might be smart.
