I have an oral contract, please help!!!!? |
me and a friend have an oral contract that he would pay me for the work that i do landscaping, i would get paid the same amount twice per month. He told me on oct. 16th that he could no longer afford me. We had an agreement that i would be paid twice a month until may. I would also do snow removal in the winter. i worked with him all last year summer and winter and he also gave me a bonus this spring for doing this for a year. he now does not want to pay because he says he cant afford to pay me through winter. Help!! I have reciepts from all the checks he has written me thus far. and also tax forms from 06. Without anything in writing, your chances are slim of being able to do anything. Oral contracts can be binding, but only if you can prove them - the fact that you got paid LAST winter doesn't prove that he had guaranteed you that it would continue this year. You could theoretically sue for specific performance however proving your case would be difficult if not impossible. Your best bet is just to walk away and learn from the experience: Get everything in writing! |
