Is it OK to file "injured spouse" if your still married and don't want to be responsible for your spouses debt


just taxes.........my husband makes a lot more than I do and claims 3 to try and help with his tax issue. I claim1 for myself and we file married filing separate and I claim injured spouse....but we are still married.....i was told that if you still live together you can't claim injured spouse.

Injured spouse claims are for people who are married and filing a joint return, whether they are living together or not. It keeps one person's share of the refund from being taken for the other one's debts like back taxes, student loans or child support.

Filing an injured spouse form would be meaningless if you are already going to file separately, since then your refund wouldn't be taken anyway for your spouse's debts. The injured spouse form would allow you to get the advantages of filing a joint return, but still keep your share of the refund from being taken.

You can't claim injured spouse if you file separately because you can't get injured.
