I am under sales & Use tax audit. If I am found to wrongly reporting my sales tax, what sentence do I get? None, you will just have to pay whatever additional sales/use tax that the state will charge you with, and in addition you will have to pay penalties and interest. One that ends with something like "Please send your check in the enclosed envelope." If it were something else, you would have been read your rights. Probably no jail time if that's what you mean, unless it's a huge amount of money and the underpayment was intentional. Otherwise, there will be fines, interest and penalties, in addition to paying the actual sales tax. No sentence as this isn't a criminal case, just an audit. If you are found to owe additional tax you'll be required to pay it, that's all. It is rather rare that such an audit turns into a criminal charge. If you have intentional defrauded the state that may be of concern. In most cases they are happy to get more money out of you than you thought that you owed. You'll have to pay the taxes you would have owed, plus some kind of monetary penalty, if you just made a mistake. If you filed a fraudulent return deliberately, it could get more serious. |
