How can I "patton" a name?That is, wanting to start a label name.?

I want to start a clothing line, and "owning" the name is on my top priorities right now incase anyone comes up with the same label name.

You need a trademark, and you do not need a lawyer.

First you make the name.
Then you make a logo and you put a little TM up in the corner.

Then you go to the patent office and read about how to trademark.

Then you draw up the papers, which you can find templates for online, or look at other ones by searching the trademark office online (www.uspto.gov)

Then you pay $$ and submit with the application.

They will let you know if you are awarded the trademark or not. If you are approved, then you get to put a little (R) up in the corner of your logo.

OR.... the cheap way is "through use" meaning that you put your trade name on everything, even do a logo, and make sure you use that little (TM) and use it on EVERYTHING.... and use it nationally (meaning put it on the web and e-brochures, etc.) This is called protecting your trademark through use.

Remember that the purpose of a trademark is so that no one can use the goodwill of your company/product names or identity for their own profit... so many companies use the mark "through use" until they are generating enough money and customers that they need to protect from others stealing the identity.

Presumably you want a trademark. And to get that you need a lawyer.

As others have said, you CAN'T patent a WORD. You are thinking about a trademark. You have to USE the trademark before you can register it.
