What is the max amt. of time an owner can lease a home? |
we are the tenents at the present time, in a 3 yr. lease. Is this in violation of the civil code? Is ONE yr. the maximum? I am refering to a residential home. Can the owner of the home bring suit against us for the balance of the rental aggrement, or are they in violation of any law because of the length of the lease? In most states the answer is 99 years. In certain states the amount of years is more vaguely defined by something called the rule against perpetuities which is not applicable. No, 99 year leases exist in real estate. I dont think so. Usually its year to year, but I dont know of any laws in the states I know that says you can demand 5 years ect. I think the landlord is in their right to have you sign a 3 year lease if they wanted too. Ive had people ask me to guarantee 10 years on a lease. I said okay I will only do 5. Its a negotiation. Ive never heard of a rule against that. I ma not sure of the asnwers all i know is we have ours setup thru a lawyer and its for 30 years! I assume that you want to bail on the lease. If you simply leave, you will be sued, but they must make every effort to re-rent the place as soon as practical. Even if you lose the case the judge will probaly not award any more than three months rent. Negotiate and pay a reasonable penalty. |
