Can legal action be taken if the landlord didn't give a 30 day notice? Instead we got a week. What can we do? If you got a 7 day pay or quit notice and you moved out in those 7 days, it is perfectly legal. If you hadnt moved out in 7 days, he would have taken you to court. (This is if you owed him money) This means you voluntarily moved out because you owed him money and couldnt pay. He will still take you to court to get his money, late fees, any damages, and court fees. If you have a written lease, that document tells how much notice you must receive to terminate the lease. If you do not have a written lease, then 30 days is the customary notice in most states. If the landlord does not give you the requisite notice, you do not have to leave. He will not be able to get an eviction order if he did not give the proper notice. If you are able to get out in a week, and would like to cooperate with him, you might ask for some compensation for terminating early. Perhaps he would be willling to pay your moving expenses, for example. I don't know what the law is where you live. But here in Texas, the land lord has to give you a notice in writing to move within 3 days. If you can't move within 3 days, then the landlord has to go to court. He or she pays the judge a set fee and the judge sends out a notice for you to be in court. Usually the judge gives a person 30 days to move. If not moved within 30 days, then a member of the Sheriff's department is sent out to be sure the place is empty and all your stuff is out of the place. Was it an eviction order?? If it was, most want you out within 24 hours. |
