What do I Do now?? Tenant issues!!?


So in my last questions I expressed that my tenants have been late on rent 3 times and altered carpeting w/o my expressed consent. They noted other issues they said were having for a while, but did not address them to me until recently. I hired a lawyer to start an eviction process. I am suppossed to meet with him this Thurs. I have sent the tenants several letter certified mail, telling them I will be in the area April 25-26 and to choose a date and time that will be good for them so that I may inspect and address and issues. They sent me an email saying they are not responding to any of my letter and that I will be hearing from their lawyer. I just received an email from their lawyer saying they wish to vacate the property and break the lease on April 30. He also said that my tenant is to have surgery and be on bed rest from April 22-29th and ask that I return at a laater date. Mind you I live 3,000 miles and have already booked my ticket, what can I do. I gave them options.

Since they did not respond my lawyer told me to send them a letter via certified letter telling them the day and time I'll be there and with a witness. These people are sly and their mother is in Real estate. My take on it is, they are buying time and they know that I can't just drive over another day. i believe the lawyer is to be a friend of her mother. Not sure. But if she suppossedly has surgery then she would not be able to physically help with the move, and then the next day after she "heals" she'll have to be out. My lease states that they will be responsible for any legal fees, court fees, and eviction fees if I have to go that route. Also they will be responsible for rent until I find a new tenant and/or until the lease expires. Am I still allowed to enter after I've told them, and are unable to return another time to inspect the property, esp if they are tryin to leave in a few days of that time. I would at least need to do a walk through. Also home is in NJ, thankx!

You HAVE a response! They were not-too-bright to e-mqil you that they weren't going to respond to any of your letters.

Ask your attorney to send their attorney a letter AND CC the tenant or send the letter to the tenant and CC their attorney.

UNLESS the lease specifically states Notice by Certified Mail only" or similar language, that's renough wasting money on Certified Mail. Send them a first class letter:

RE: Property Inspection on _____

Dear Tenant [Name]:

You sent me an e-mail, which I received at ______[time] on _______[day], Aril ____, 2008. I consider that sufficient notice you DID receive notice.

Please be informed my reservations and flight are already booked for that date. I WILL be inspecting my property on ____[day], April _, 2008 from approximately ____ to ______.

Please leave the front door and back door unlocked. I'll be as quiet as possible. It won't be necessary for you to get out of bed. When I complete my inspection, I'll make sure to lock the doors behind me.

Please be informed, should I be unable to gain access to the interior of my property, that will be considered another violation of the lease.

Its YOUR property! As long as its within the law, you can do whatever you want - or don't want.

Eesh. Sounds like a horrid mess.

Just because one of them is having surgery & will be on bed rest doesn't mean the other one won't be available to open the door for you & allow you to inspect your property.

I'd consult your attorney. I don't see why your tenants can't comply with your itinerary. Chances are if you return at the dates they specified, they will already be gone.

It really is frightening at how many schemers & scammers there are.

wow you should have hired a property mgmt firm to take care of things then you shouldnt have went through this much..

why can't you ask your lawyer this question...?
