I'm renting a house in Wisconsin that is also up for sell. What rights do I have about them coming in my home?


I just had a problem with the realtor calling and asking if she could show the house, when I had plan to have company over and I said it would not work out at this time because of my company. She called my landlord and the landlady gave the promise for them to show the house any way it that legal?

In Wisconsin twelve hours notice of such showings is all that is required. The showings must be at 'reasonable hours', of course, meaning they can't come in the middle of the night to look at it.

Check your lease for when anyone can enter without your permission. You can bet that it will allow people to enter when necessary and not at your convenience. When they are selling, you are not their primary concern, showing the house and finding a buyer is. They should make every effort to make it convenient for you and you should try to be helpful. It only takes a couple of minutes for someone to walk through. If you aren't helpful and the person buys and you make it difficult for them to see the property, wanna guess what's going to happen to your rent come renewal time. . .

I wouldn't change your plans. Let the realtor know that you'd prefer they view the home when you are not having company.

They're under no obligation to change the appointment, but you could always ask.


Who's previewing homes this week anyway?

Here in Illinois, we can not show rental property UNLESS it is stipulated in the lease. Read your lease. If there is no such clause, then I'd contact a Real Estate attorney and see what they say.

704.05 Rights and duties of landlord and tenant in absence of written agreement to contrary.

(2) Possession of tenant and access by landlord. Until the expiration date specified in the lease, or the termination of a periodic tenancy or tenancy at will, and so long as the tenant is not in default, the tenant has the right to exclusive possession of the premises, except as hereafter provided. The landlord may upon advance notice and at reasonable times inspect the premises, make repairs and show the premises to prospective tenants or purchasers; and if the tenant is absent from the premises and the landlord reasonably believes that entry is necessary to preserve or protect the premises, the landlord may enter without notice and with such force as appears necessary.

If acemill is right it looks like all you are intitled to is 12 hours notice. In PA it's 24.
