I recently purchased a townhouse in Missouri. A day care center was built directly behind my house.?


The day care center built after my purchase now completely obstructs my view. The original plan said it was to be a single level structure close to the street and not the residents to prevent the obstruction. A friend of a friend who works for a lawyer was told that the day care owners are required to pay the residents whose view is now obstructed monthly compensation for our loss. Is this true? Any validity to this statement that should be pursued? Any help is appreciated. Thank you.

Two things I would do, is make a trip to the zoning commission, and a trip to the courthouse to check with the clerk dealing with permits. If a study was performed, dealing with a single level structure, and then a two level structure was built, the neighborhood impact study may have been ignored.
And yes, a lawyer dealing with such suits, may be an option.

Unless you have an easement to preserve your view (believe it or not, these do exist), there's not much you can do.

If the builder or seller of your home misled you and told you in writing that your views would not be obstructed, then you may have some recourse against them. You would have to prove that they knew that your views would be obstructed, though, and that's not easy.

Good luck to you. I'd go see a Real Estate Attorney about this, and don't rely on your "friend of a friend" free advice from a clerk at an attorney's office.
