Can we ask renters to leave earlier then what was actually told to them?


My fiance and I have a townhouse that we recently purchased in Ontario. He (fiance) bought out my mothers percentage - and now legally we own the house together. Anyways, last year we decided we would move into the house in July 2008 just before we got married, circumstances have changed and we would like to move in earlier. However, we told the the renters that they could stay until July 08 - can we at all ask them to leave earlier with 60 days notice?
Any advice would be greatly appreciated. Please note, I do need Canadian rules and regulations advice on this.

You can ask them to leave. If they have a lease they may say no. In that case you may want to consider a pay off to them for changing your move in date. They may or may not bite.

I do not think Canada is very differant then the US in this regard.

In the US you are legally entitled to give them notice prior to the lease ending if you are planning to live in the house yourself. The right of the property owner to live in their property overshadows renters rights.

You may offer them cash to leave early.Be careful about paying them before they leave. They always say that they need the cash to find a new place and can't move till you pay it. If you give them the money, you may have to pay again to get them out. They may decide to stay all year. Then what would you do?
Give them the 60 day notice and then tell them you'll give them some money like $2000 if they leave in 30 days.

Sorry I don't know Canadian law, but in the US you could just give the 60 day notice.
