Is it lawfull to charge a late fee in Nyc appt.s rent when there is no provision on the original lease? |
I always pay my rent by the 10th. Never in the past 8 years had I been charged a late fee. Now a $25 late fee appaered on my bill. In the original lease there is no mention of late fees. You can get that back by showing them your lease contract. They should give it back as they technically did not mention that and then they could revise it. That sucks ***. Go to the leasing office and remind them of this it should be easy to get removed it not speak to a lawyer I don't think they can do that, but you can call an attorney and ask for free! I think it is strange for you to pay late..usually anything after the 5th is considered late...but anyways..to pay late and not get charged. If there is no mention of it in your lease then yes you could sue for that. But I would double check on the lease. Also if the apartments is under new management...and they changed that in the lease and never gave you a new copy of the lease agreement in it with the late charge added then that you can sue for too. Double check your lease, then go to the management and provide them with the information and see if you can get your money back. If they still refuse I would then pursue it further. Good luck! It doesn't sound right. However, I would guess that you've missed something pertaining to (i.e. late charges) in the original lease~OR~they've recently posted something in their office stating this. Sounds like you will have to call them and find out as I don't think anyone on here can help you with this one. I agree that it sounds screwy. If nothing was mentioned in the original lease and you have not been told either through any source of communication, such as written letter, phone call, personal appearance, email, etc., then you must explain to them that you will not be paying this late fee already been charged to you for this month. |

I'm so sorry for your loss. I'm with the previous poster. Stick with what you have for now. Maybe rent out the house in central Fla to someone you know (and trust to pay you!!) for enou... I'd look at the possibilities in a risk/reward scenario. Sure, you could make a little bit of money if you buy a house, live there for 10 years and then move onto something different/better. ... No both are very poor choice right now. I do both, I have been doing home inspections for 4 years and appraisals for 5 years and my income has dropped by 50% in the last year. Yes it may be a buyer... Really, I'd have to know your entire situation. Were you late on any mortgage payments after your sister moved out? How long have you been living with family? Maybe they're telling you th... They would approach you If its every gonna happen. They know where they need and want them. ...i wouldn't touch anything without a contract. at present you have a lot with "service" (hydro, water, etc). the building in it's present condition..is"what it is" h... Most foreclosed homes are available on the courthouse steps for auction. But bare in mind that most of those mortgage companies send attorneys to buy them back for themselves ( maybe for insurance ... Sounds great. I would lock in now. You might ask for a loan that you can pay half every two weeks. This will take years off of your loan. Check it out. ... |
