My landlord made a mistake on the lease with two conflicting occupancy terms, which one is legally binding? |
here's exactly what is says; " ... together with all appurtenances for terms of ( 1 ) years, to commence on ( Jan. 5th 2007 ) and to end on ( June 30th 2007 ) at ( 12 ) o'clock ( a ). m. ." everything in parenthesis is handwritten and the rest is typed... my question is even though he wrote one in the number ( 1 ) , does this override the date that was written in or vice versa? the dates were changed for security reasons as well, but the time difference is the same. if I move out, can he hold me responsible for the lease EVEN THOUGH he is the one that wrote it and made this mistake? i live in the state of new york as well if that helps.... the dates are different on the lease, i changed them for the question. The dates that are written in would prevail over the (1) year, as you are not supposed ot leave blanks in contracts. The first signed agreement is usually binding. |
