Is my landlord trespassing?


Long story short, I live in Los Angeles. I presented my 30 day notice but I moved out fast leaving my place empty for 15 days. The management company called me to see if they could have the painters come in and do some work but I said only if I got half of my rent back and if we ended the lease. They were going to check with their managers but never got back to me.

Last night my girlfriend send me some pictures of some work that has been done on the apartment without my consent. My girlfriend also mentioned that they left the door unlocked. Is my landlord trespassing? What are my options here?

Yes your landlord is trespassing. Talk to the management company first, if not resolved. Take it up with the appropriate authority which will make a jurisdiction.

No, once you are out and your stuff is gone, you have basically vacated. He doesn't owe you money back and he doesn't need your consent to do the work. He didn't need your consent to paint it or fix it up while you lived there, he only had to tell you he was coming in to do it. But since you have moved out... why in the heck do you care.

It's not considered trespassing. Though you are still under contract to live there, you left the premises along with all your belongings. You forfeited the last 15 days by moving completely out. If there was still belongings in the apartment that were yours then you would have a case. However, there's nothing you can do at this point.

Yes your landlord is tresspassing and you didn't forfeit anything.
You paid for those 15 days and he had no right to enter and do work on the apartment!
You should call the manager and then tell them you will take them to small claims court if they don't settle with you!~V.

I am sure your lease has a section in it about the landlord having access to do repairs. What if a pipe started leaking in the apartment? would he be required to leave it leak because you don't want him in the apartment?

You don't have a leg to stand on.

If you have not turned your keys in, you have not "surrendered" your apartment. They should not have entered your apartment to begin their make ready process. They should only have access to your unit if there is a maintenance emergency. I would fight for a pro rated amount of rent.

Oh My God! They came in and painted an apartment that you don't own and aren't living in? The nerve of the people trying to actually maintain an apartment that's vacant.

Let it go, it isn't worth it.
