My apartment complex just sent me a bill saying that I owe them for damages that didnt exist.? |
First of all I moved out on Oct 31 and the move out statement was dated Nov 30. I called twice during nov and both times I was told that the information had already been sent out in which I didn't receive until Dec 20 in which had a letter from a credit collector. They say that the walls where black???? in which I had maintenance spot paint for me so it was perfect, and they said that they had to replace all of the vinyl blinds, "why did they have to replace the blinds?" well they said that they where dirty. Long story short people have petition to get the media involved with this luxury apartment complex. Regardless Im ready to take these guys to court. Any suggestions.... time is of essence You should always demand a walk through on move out. Take pictures, so that you have some proof should anything come up. first of all you are not responsible for blinds unless they where distroyed. dirty is not damaged! Take them to court, but I hope you have proof. Do you have pictures that were taken in the apartment, maybe from a get-together or something that would help. And in the future, when you move into a new place always take pictures of all existing damages, cleanliness, etc.. and take more when you leave, use the date function on the camera so you can prove when they were taken. This is something I always do when I move. Also, insist that the move in inspection and move out inspection are done in your presence, don't settle for anything else. Did you pay maintenence to spot paint that wall? With a check? Then you have proof and they are stretching this point a long ways. Dirt on the blinds? C'mon what about normal wear and tear? and the term is broom clean not Make ready! Pull that old lease out and your cancelled check, head to small claims court and file it! Bring your friends who saw the wall and the blinds. If the blinds weren't black! the friends can speak to they weren't black and that should get them set straight! Good Luck-they are ripping off more than just you I'll bet! do they have pictures? did you fill out a move in "inventory" form? if yes to both, compare, and you will more than likely see that they dint have a foot to stand on for most of the charges. Also, in the cleaning section of your lease there should be a paragraph about "normal wear and tear". Dirty Blinds is normal wear and tear and does not = replacement. |
