Living with my boyfriend he is on the lease how do i get him out? |
i am living with my boyfriend of 7 years we have 2 kids the relationship is over but he wont leave . how can i get him out if he is on the lease as well . Dont want to have to move w the kids they love the house Only a judge can force him to move. He has the same legal rights to the house and his children that you have. Since you have children you have to treat this more like a divorce and less like a boyfriend. Ain't no way outside the court room If you are the actual tenant and added him to the lease, then talk to the landlord and ask to have your problem removed from the property, this situation my need the services of a lawyer........... You'd have to get a new lease written up. You need to check with your landlord if that's even possible to do before the lease expires. Restraining order? But, you need a good reason. If it's over why does he think it isn't over? MAybe ask the management company if you can write a separate lease on another apartment as you are breaking up with your boyfriend. If he isn't paying the rent they will probably be happy to write it an extend it. Then you have more of a reason to have him out if he is no longer on the lease? Worth a try. I am attaching a real estate law link for lots of states but, I don't know if there will be an answer there. Good Luck |
