Looking a purchasing a home but it is currently rented out? |
I live in Victoria Australia and am looking a purchasin a house however it is listed as rented until May 08. What are my rights if i was to purchase the house? do i have to wait til then or can i just give them notice? I had this issue with one of my own properties... I wanted to move in prior to the rental agreement with my tenant running out. So I spoke with them about it... They knew that they would have to move out soon (few months) anyway so we came to an agreement that if they moved out by an agreed earlier date then I would pay their removal costs for them. Cost me $1500 but I got to move into my house when I wanted and my tenant was happy that they had not had to pay their removal costs. Win /Win situation for all of us! Would highly recommend talking with the tenant, you never know, they might just want to move out early! Wait til then because it is on lease. You can get sued for that then look for another one You need to get a look at the renting agreement as they differ. Some agreements state that you have to give the tenants a certain amount of notice before you can get them out and others have a clause in them that can have them rented up to 12 months ahead. Just ask for a look at the lease and then get your solicitor to go over it. It's different laws in where you live. You should check out your housing code in your area. Here we can kick people out of their homes in less than 5 days. Also take in the fact of the people living there too. Take care. you can still purchase the home, but if these renters have a lease..you MUST wait until 30 days before their lease runs out to tell them that they must move. You may be able to let them know of your plans sooner than that..but you cannot force them to move until their lease is up. They are protected by that. I don't know about Australia,but in the US the sale of a house changes the terms of a rental agreement.You'd have to check with local housing authorities about rules that apply,especially how much time is needed to evict. In the USA if you buy a home that someone else is renting, once the sale is complete and you are the owner, you can give the renters a 30 day notice to move. You are the new owner and any lease they had is no longer valid. Check the laws in your city. |
