I just filed bankruptcy and my car not listed as secured debt.?


I filed bankruptcy and my car is not listed as secured debt. The bank charged off the account and the car was abondoned 6 months ago from breaking down. I advised this of the repo guys when they came to my home and the bank as well. Will the trustee require me to locate the car or what will I need to do before my hearing if the bank cannot locate the car. I did not list as a secured debt because I dont have the car to surrender, reaffirm, etc.

I would contact the bank that repo'd your car, and ask for a letter stating they took back the car. I would say from this point on that it would be a police matter, if the car is not in the place you left it then someone has it. Just take all the info you have on the car with you, any paper work that might have the VIN #, and you should report it anyways, I'm assuming the car was tagged and registered in your name, which means it probably still is, which means you'd have a liability if some one was injured by the vehicle. So honestly I wouldn't be to worried about the trustee right now, but worried about reporting it to your local police department.
