Can I sue my roommate for not paying his bills?


If I had a roommate and he didn't pay rent, electricity, cable, etc. all the bills that he was supposed to pay, and I was stuck paying them for a month or two before he moved out, can I sue him in small claims court for the money that he owes me?

Err.. I mean I'm pretty sure I can but am I likely to win? What would make me more likely to win? I already have copies of all the bills that he did not pay, along with 2 roommates who were there and were aware that I was having to pay his bills for him.

Any advice for me?

i have a copy of the lease with his signature on it.

I know I would . he lived thee n did not pay any bills u can sue him for his part of his rent . oh did he get any mail to the house If so keep a piece of the maill only junk mail with his name on it . this will showed he legally lived their .

I would think you would have a very good chance in small claims court.

If you have witnesses that will help. Did he sign a lease? If so, then you have him where you want = paying you for the rent owed. Also, I hope he gave you 30 days notice it not he is screwed there again.

Dont pay for him. If you have an agreement in writing that will help!! Witnesses will help. Sue in small claims Court its designed for non lawyers its inexpensive and less formal rules of evidence. But look at the jurisdictional limitations on the amount you can sue for

Proof, proof, proof. Make sure you have a signed agreement, receipts showing that you paid his share. And witnesses are good too.

if you have a contract in writing it might work...
you have to have proof he agreed to live with you and to pay his share..you also need proof he intended to leave in writing....if he has not put anything in writing it is your word against his.
He could say you invited him as a guest to live with you.

Do you have a written agreement or is everything verbal? That will make a big difference.
