UK QUESTION - Redundancy - can anyone point me to a site or answer some simple questions please?


Hasn't happened yet, but I hear reliable rumours.

What I need to know is:

1. Do you still get the first 拢30k tax-free?

2. Do you still get a week's pay for every year worked? Is this every complete year, or do I count the current year? Is it capped - if so, what's the cap?

3. Do they have to pay you for holiday entitlement accrued during your notice period (I doubt they will make me work my notice)?

4. Is there any point in challenging the decision or is it a foregone conclusion (i.e. they wouldn't do it if they didn't have a watertight case. They have a large HR dept so they know the law). Does anyone have any stats on what percentage of challenges succeed?

5. Do I have to decide/sign things right away, or am I allowed to go away and think about it/see a solicitor? If I do insist on more time, can they change the terms of the offer? (i.e. can they bully me by threatening to withdraw the offer and replace it with the statutory minimum unless I sign there and then?)

If you are UK based, then :

1. Yeap, the first 拢30K is tax free

2. The calc for the payment is based upon your age and your length of service (service before the age of 18 doesn't count) and once you are over 41 it changes to 1.5 weeks, I think.

3. You are legally entitled to holidays under the Working Time Directive, so any you have been unable to take should be paid up to you.

4. Yes - it is always worth challenging the decision!! Depends on the policies of your organisation as to where your right of appeal lays, but you can always go to an Employment Tribunal to appeal against unfair dismissal. You would need to cite the reason for the appeal - eg, unfair redundancy criteria, etc.

5. What do they want you to sign? Is it a Compromise Agreement, that says you won't appeal? If so, then I know that I ask people to sign these but I can't enforce it so many don't. And if the policy of the organisation says that you are entitled to receive enhanced redundancy payments, they cannot then revert back to the stat amount just because they want to.

I have just been through a redundancy, so I know just how you feel.

The answer to your first question is yes, the first 拢30k is tax free

You get a weeks pay for every year worked, but it is capped at 拢310. That is the statutory amount anyway. Some companies pay more if they want to.

I suggest you call ACAS on 08457474747 (http://www.acas.org.uk/). They will give you free advice on all the legalities.

redundancy in law is still worked out on age and service you need be be at least eighteen with two years service after that you get one weeks pay for each complete year,the timing is from the date you start and age from your date of birth,when you reach forty you get a extra half weeks pay up to a maxium of twenty nine weeks,if you have holiday entailment you'll get that as well,you will also get any pay due to you if you have time worked in hand ,most larger company's have made agreement with trade union's over redundancy and usually the agreement betters the state system,if so then you might be entailed to a company pension this can give you a lump sum to and a pension payable each month,you'll receive a notice of entailment from your employer given you time to thick it over along with all the information you'll need don't bother with legal moves it will just tack longer to sort out and cost you
