Returning a gift on amazon, one year later and used?

i sent a gift to a friend in america over a year ago from amazon with my money and in my name. iv let him have it for this long but iv decided he doesnt deserve it. Its still in his house but its technically mine as i bought it.

Im wondering if i can get a refund from amazon if its been open, and used, and over a year, can i get my money back?
Also, is a return of this item, likely?

#1 --- By american law, a gift is a gift and belongs to the person who received it. He technically does not have to give it back.

#2 --- Amazon has a 60 day return policy. So even if it wasn't used, open, and all the rest that makes it HIGHLY unlikely for a return, you are about 300 days outside the ability to return a product, so your answer, simply, is no.

Its actually not yours dear. You gave it away as a gift. Once you did that, you gave up all rights to the property. So unless you can prove, beyond reasonable doubt, that it was a loan to this friend of yours...and you go through the process of taking him to small claims court or something...its gone, done, over.
