Ebay/PayPal dispute, if I want a refund instead of a replacement, can I get one?

Alright I ordered and paid for an item on Ebay using PayPal on December 3rd, it is now December 27th and what was suppose to be a Christmas gift never arrived, I had been in contact with the seller and they told me that by the 26th if I still had not received my item the would either send a replacement or give me a refund, I emailed them on the 26th and got no response, so today I filed a dispute with paypal and the seller says they are sending a replacement tomorrow, but now I just want my money back, if I esculate my dispute to a claim can I get a refund? any suggestions on how to get my money back instead of a replacement item? thank you :o)

I shouldve added that one of the emails from the seller, said that I would have a choice of either a refund or a replacement, but now they are trying to send me a new item, when all I want it my money back, will their email make a difference?

I think it's going to come down to the sellers return policy that was specified at the time of the sell.. if it wasn't a lot of money go ahead and get your item and leave them an awful nasty feedback.. negative feedback will hurt the seller, the feedback you leave will be there for the whol;e world to see.. you can say he failed to make timely shipment, had bad communications. Not a recommened seller .. he will most likely make you an offer to accept the cash back if you will willingly remove your negative feedback ,, negative feedback will taint his reputation as an ebay seller
