Can I be sued for this? (magazine question)?


I am starting a non profit online magazine for women.
I am not charging readers to view the magazine and I want to put
advertisements in my magazine for companies like Lancome, Clinique, Steve Madden shoe ads, beauty products etc.
I will put in the current ads and I am not charging anyone to advertise either.
I wanted to know if I put a clause in my site that says the advertisers are in no way affiliated with my mag or the views the mag expresses. Do you think companies will be mad or appreciate the free advertising?

you would definitely have to check with the marketing managers of each of the companies. Some advertisers don't like their adverts being seen on back covers of mags for example. Especially the premium advertisers you have mentioned. Worth a check, most would probably quite happy to do it but you wouldn't want to get in any legal trouble by not checking first.

You cannot do that because it violates copyright laws. Those brands are copyrighted and the companies can go after you for using their names without their permission.

Why would you want to put in free advertising without consulting the companies? If you want to put reviews for them, that's great, but you will definitely need their permission if you want to give them "free advertisement".

No, you are not entitled to run someone else's copyrighted images without their approval whether or not you are profiting from it.

Nope dont do it, you can mention them with the copyrigth sign next to the product name or whatever it is, when you talk about it. But you should put random ads up without their permission.

You need to contact the companies whose ads you intend to run before doing it. There are copyright laws that may prevent you doing this.

All magazines, TV networks, etc. claim they are not affiliated with advertisers. I'm sure tons of companies will want to advertise for free, but I don't understand how you plan to fund the magazine without charging anyone. If you are not charging advertisers, there is no reason to include advertisements at all.

Companies such as those you've listed wouldn't allow you to advertise with a disclaimer. They are too well-established to seek free advertising anyway. Sorry!

The ads are copyrighted material, and just because you think you're doing them a favor, it doesn't mean they'll see it that way.

Those companies will want to have control over their image, and how their name is used. How do you think they'd feel if your magazine was about the Klu Klux Klan? Wouldn't they be upset?

To protect their rights to their copyrighted material, they have to defend against any unauthorized use - even if they like your magazine. They're required to protect their trademarks, or they lose the right to defend them.

They'll also say -- rightly so -- that you're appropriating their good name to give legitimacy to your publication.

Those are copyrighted. I believe you can be sued for unauthorized use.

I think you could be sued. They likely won't SUE you, but you may get a "cease and desist" letter from various lawyers. Companies want to choose who they advertise with. I would suggest you just find the right contact and ask if they would like to advertise. The worst they can say is no. If the big companies say no, how about some free or low cost advertising from hip, independent companies run by or for women? There are lots of those out there, and they need exposure!

Yes I do, I think that they would object....only because they would want to know up front what your magazines saying, they wouldn't want to be associated with anything that they didn't approve of, if you asked and they approved that would be different, but I doubt it !!!!!!!!!! This is my opinion only, I could be wrong !!!!!!!!!!

They will want to be asked and notified. And putting that clause is a necessity but they will still want to be asked.

you will have trouble tell your have a track record before they want you to put them in with your name.

you can be sued for anything in the USA,, it is the law, the questions is am I liable for this, is your question, and the answer is yes you are. get a LLC and reg. in NV, have a atty over see your records and be Atty of Rec. for your company

It might be much better if you contact said companies !! & to asure them that there's no catches,tricks or schemes to it !! just a nice gesture you thought of doing all on your own !!. But if at all possible,' Since you'd be doing this !?! if allowed !?! Just say you'll do this on`going for about a month !!?!! But & or IF you get any that shows great intrest... You might want to show the proof to them !! But conceal any screen names !!. That should show said companies that your site gets hits from many that are interested in the products !! & make a deal with them & say ?? You'll do this maybe off & on during the day !?! Or about 4 to 5 times a week for however many hours!?! & they may send you a small promotional fee !?! <IF> your site gets alot of visitors often about said products !!?!! (G/L)~!!!
