Time limit for employer to contest unemployment claim?


is there a time limit that an employer has to contest to an unemployment claim in the state of illinois? also, is there a difference between the employer contesting, and the employer appealing the claim? any other information on unemployment claims in illinois is helpful. thankyou.

It looks like the limit is 10 days.

How to Contest a Claim

Under the UI Act, you have a right to protest your former employee's claims and to appeal any adverse decision.

When a worker files a claim, IDES will mail you a Notice of Claim (Form BIS- 32). The Notice of Claim will tell you if you appear to be the chargeable employer for that claim. You can use the accompanying form to protest either the claimant's eligibility or your status as chargeable employer -- or both. You have ten days to file your protest by returning the form, or a letter in lieu, to the address indicated. It is important that you reply by the due date indicated on the form; otherwise, you forfeit the right to appeal any subsequent decisions.

The employer is normally contacted pretty much immediately, and if they don't respond, they lose their right to contest/appeal/whatever unless there are some very strange circumstances involved.

Depending on the state the unemployment claim is in it varies state by state. However, the employer is notified almost immediately if they receive an unemployment claim. If they have an agency that works on their behalf then they are notified and then the agency will notify the company. The state usually gives the company a few days to respond to the claim and provide documentation. Then the state will review the unemployment claim and they may either a. make a decision or b. request further information. After all the information is gathered they can then make a determination. When the determination is unfavorable, the party can dispute the claim and request a hearing. They usually have 10 days to appeal. For instance, if the state determines that the employee should receive unemployment benefits; then the employer has the right to appeal the decision in which it will go to hearing and vice versa. After the hearing the Administrative Law Judge will make a determination. They will either side with the employer or the claimant. They will listen to testimony and gather all the FACTS pertaining to the claim.

After the ALJ makes a determination it is final. Either the claimant is awarded benefits or not.
