How does a company dispute an age discrimination claim if employee is age 42? |
If an ex employee is in protected age group, how do you dispute this complaint? Employee was not fired for misconduct or work performance just "at will" employment guidelines Well, why DID you fire him? If you don't have an answer for that other than "I just wanted to" you'll probably lose, especially if he was replaced by someone younger. And this would be a good time to talk to a lawyer, not take advice from Yahoo Answers. To disclaim age discrimination, the company will have to show proof of other reasons for letting the employee go. The ex-employee will have to show that he/she was doing everything within the job discription. |
