I need a legal opinion about my contract....?


I was fired just yesterday and its stuped and all but i cant fight it.... so.... they only paid me up to the day i was fired... but this is what my contract says.....

This agreement can be terminated by either party by giving one month's notice in writing or the equivalent of one month's salary as payment in lieu of notice.
"company" reserves the right to dismiss summarily any team member found guilty of misbehavior, including but not limited to, gross negligence, willful misconduct, or breach of discipline.
If, within the Term, the employee decides to terminate his employment, the Company will not be responsible for his/her return airfare to point of origin.

as a reminder I didnt recieve a month's notice at all.... not even by mouth....

What im trying to ask is should i get a full month's pay or should i just get paid only for days worked?

Depends what you got fired for, gross misconduct would usually mean that the company doesn't have to pay you anything beyond the hours you've worked. Check the contract for the definition of gross misconduct though, some firms throw it about to try and get out of this sort of things. Your local citizens advice bureau will be able to advise you if you can claim or not. On a side note, you should always be entitled to fight a dismissal through an industrial tribunal, unless you got caught boffing the bosses daughter or something...

Depends on why you were fired. They kept it pretty open on "misconduct" not limiting it, and "summarily" basically means without any notice, so you probably are only entitled to be paid for the time up until you were fired if ANY type of misconduct was involved.
