Was I a victim of unfair practices act?

I just tried to get a job at Jimmy Johns in my area, and... was turned down before getting a proper interview. They called me the next day after dropping off the application, I knew they needed people, but I was so nervous I paced around the place a little while waiting, and I noticed the scornful looks they gave me. When I called again, I was told "they need more outgoing people than I..." Is this a fair business practice? I've never had this happen to me before, never been fired from a single job, so this was very out of the blue. When I saw the people working there, I felt I wouldn't be too welcome, but to be turned down by my very appearance... I'm speechless.

So..... you're saying that those with 'sparks of life' that they need never pace and are never nervous or distracted? You didn't even answer my question... you just took their side

Your treatment isn't illegal, if that's what you are asking - a company has a right to interview, hire, and employ whoever they want to as long as it's not decided based on a legallly protected class, like your race. Companies don't usually interview everyone who applies, and certainly aren't required to.

Good luck on the next application.

YUP you are boring to them and they need someone with a spark of life not a pacing ponderer

That was not unfair practice -- they have a right to employ people who will fit their needs. You obviously exhibited traits that disturbed them.

Next interview, take a deep, calming breath, and relax. Keep your nervousness inside. Think positively and use that pent up nervousness to exude energy for the job.
