Do i have to quit my job? |
Hello...well i was wondering if i had to quit my job as a home health aide because im pregnant? what happened was that i had to get a work release from the Dr. for my job...well they gave me a paper that just pretty much said that as long as i dont do lifting of more than 25 pounds on a daily basis, then it would be alright for me to work...well my work called and told me that i couldnt work and i would have to quit my job if i didnt get another note from the Dr. stating that i have no restrictions!! i was just wondering if they can do that based on all the laws in texas?! please someone that makes some sense help me out!! thanks sooo much!! You need to contact the Texas Department of Labor: http://www.twc.state.tx.us/ Unless you can get the dr. to write another note stating you are free to work with no restrictions (doubtful), you are probably done working for now. It's not like you have a desk job - your job is physical and requires heavy lifting, right? Find something else to do for the next 9 mos. yes they can do this legally, as long as you routinely have to life 25+ pounds, they can let you go on the grounds you can no longer perform your daily job functions Your work is wrong for advising that you need a note stating there are no restrictions. Since you are pregnant, you're basically considered disabled. Your employer, before ending your employment, must make an effort to give you a reasonable accommodation. That is, find other comparable work for you in the company to do that complies with your doctor's orders. If they are not able to do that, then they may end your employment. Should they not be able to prove they tried to make a reasonable accommodation, they may be in violation of the Pregnancy Discrimination Act. |
