Is this legal? (work paycheck)?


Is this legal?

My husband gets paid salary, this year he gets 2 paid weeks vacation. He requested two of those days in March (although they have to wait till end of year, but got permission). He later quit this month (April). Can they deduct those two days with 'no pay' when they gave it to him as 2 days of vacation?

Under the Fair Labor Standards Act, he is an exempt employee. However, vacation time is a perk to employees. It does not have to be paid out to the employee. Depending what his contract or handbook states. It might not be ethical but it is legal

It sounds like your husband was given permission to take those 2 days of vacation prior to actually accruing them under the company's leave policy. If that is the case, it is perfectly reasonable that they would recoup the unearned paid time off when he left.

It also depends on what state you live in. If you are in an "at will" state, an employer can literally do just about anything they want to do and get away with it. You could be there 12 yrs and they walk up and say, "We no longer need you here....good-bye." and you go....nothing else.
