Unemployment: They rejected me, saying that i quit the job, when i didnt. What do i do?


I dont know whats going on.

After I enrolled in school, my employer stop making schedule for me, they didnt give me any notice, or anything.. when i confronted my manager, he said, that they dont have that schedule that matched my school schedule.

What do i do?

you can appeal and should, your denial statement should tell you how to appeal.

since you left your job due to school in most states you won't be able to draw unemployment.

You changed your availability so you in effect quit.
the employer is not responsible for you not being able to work the available hours.

You need to contact the government agency that oversees unemployment law in your area. It sounds like the job was "work at will" which means that you can leave a job at any time for any reason, and can be let go for the same. If your schedule changed and they were unable to accommodate, that is in essence quitting your job, in most cases.

They (unemployment) should have an appeal process. Appeal the decision.

If unemployment said that you quit they must have gotten it from your former employer. You need to talk to your former employer and get it straightened out and then apply again.

You can appeal, but it will probably not help you. Unemployment requires you to accept any open employment, they do not care about your school schedule. The fact that you are limiting the hours you are available means you are not eligible for unemployment

There is probably a misunderstanding between your employer and you as to the correct status. First, discuss the matter with the employer and straighten any problem. about scheduling. If there is still a problem, appeal the decision with the EOC ( Equal Opportunities Commission )for resolution.

You have the right to file an appeal with the UI office - there should be instructions on the notice of denial you received which tell you how to do that, or you can visit their web site. You will be assigned to a date for a eharing before an administrative law judge. A representative from the employer may be there as well. Make sure to provide any supporting documents or witnesses who can coabborate your point of view.

However, you may have effectively "quit" your job by establishing a school schedule which conflicted with the employer's work requirements. In this case you would most likely not be eligible to claim UI.
