Can i get sacked for this????

Hi, Ive been signed off for depression (im 18) im doing an apprenticeship so i learn while i work. Ive recently been signed off due to depression, as i will be missing out at work, can i get sacked for this? Im really worried as i think i might! Help!

So i can get fired! What should i do? Go back? I cant afford to get sacked!

It is illegal to sack you if you have a valid medical certificate. If you are unfortunate enough to be on sick leave for a good while(about a year), the company/employer may decide that you will be unfit for work and could decide to release you on medical grounds. This is usually a last resort and I hope that you will be feeling much better before then...

No - your employer has no right to dismiss you for illness.

not if you have a medical certificate, eventually after a year or so you can be dismissed due to medical capacity but it takes a while or you can sue.

you definately shouldnt get sacked. its illeagal dismissal. as long as you have proof from your doctor that you are depressed then they cannoy fire you. you could sue them.

Your placemebt could go down the line of unfit to work with them, They could release you that way

unless you have a contact they says you cannot be ill then no you should not be sacked. if you are off for any length of time your employer may ask to see you and come to an agreement for you to finish you job . if they do try and sack you get the backing of your job center as they would be breaking the law to sack you while yo are on sick leave.

No - depression is no justifiable reason to sack a person unless of course they go beserk with a machete at work! But most people who are depressed would probably turn the machete on themselves rather than anyone else. Don't worry if your boss sacks you - take him to the cleaners for unfair dismissal.

no as long as you are following the rules ie was self signed for the first 3 days then sent in sick note for the rest of the time

just make sure you keep contact with your employer and let him know how things are going

Depression. Amazing how many people seem unable to work due to this condition. Now I can't think of anything more depressing than being shot at and blown up by the German army, seeing true friends die and lose limbs. Aren't we lucky that the British Army didn't all decide not to work due to depression during the second world war?

I've been taking anti-depression tablets for 15 years and believe me, I've had some seriously low times. However, I have never taken a single day off work, no matter how bad I've felt. I just think it's far too often used as an excuse to be lazy, and don't try to convince me of anything different. So before you start calling people names in future just engage your evidently hollow brain and at least try to show a little intelligence.

You cannot be sacked/dismissed whilst on sick leave you could take them to a tribunal for this especially when it involves depression!! Make sure you always hand in your letters from the doctor..if you are late in handing that in then they may have a case to dismiss you....check with citizens advice thats what there there for............Good Luck!

It depends. In employment law, your employer has the right to replace you if you are off work for an indefinite time.You have to give your employer an account of your progress with this illness, and a possible date when you will return to work. If you cannot do this, then after 6 months your employer can dismiss you with no come back on him.

I don't think they can dismiss you. A mate of my went sick with depression and was off work for a good 4 months. Although sick pay does get halfed after a certain legth of time. There is no legal reason to dismiss as far as i am aware as long as you have carried out the correct procedure and got doctors notes etc.
They may be able to rid of you at a later date but it depends on the terms of the contract you signed for the apprenticeship. Do you get a 3 month trial period? if you are signed off during that they may be able to release you.

If your doctor did this then you need to take a note from him and speak to your employer about it and ask them what will happen if you don't return.

You can only be fired if your company has a written statement saying you can be dismissed for repeated medical leaves.Most company's don't .The one I work for does.Make sure to check with your manager or supervisor to find out if your company has this policy.It has to be signed by you saying you understand it,sometimes employers slip it in among other pages to be signed at the time of hire.

It honestly depends on how much time you take off. If they fill your position and can prove they have no other open positions then they do not have to give you your job back. Its not fair but it would be legal

I've see people be off for almost a year with depression and return to work. If your doctor signed you off then you're ok .
