Hr legal problems uk uk uk only!!!!?

From your answers some of you did not understand me. let me reexplain. I had an investigation meeting for leaving work followed by a displinary meeting. At the first meeting she interviewed one of my friend. Six weeks later, she says that she does not belive my excuse for leaving work (family news) and she says my friend said that i was harassing him (word for word), that he would take me to court... She asked me NOT to approach him again. He came and spoke to me to ask me about the ouctome of the meeting. He told me he NEVER said I was harassing me. I Think she asked me not to talk with him so she can cover her lies ( she hates me because of past problem)wot makes her case even worse. My manager was also involved. I want to sue them for slandering at me and trying to cover their lies by giving me an unlawaful order. can you come up with a law saying she has a legakl right to ask me not to approach somebody? I already have the one for slander and it is very serious

There may not be a law, but it is usually written into your contract that if you're under investigation for disciplinary issues then you may not contact other employees of the company.

You're not clear on whether the person you refer to as your "friend" is an employee of the company, but I'm assuming so because I can't understand why HR would have interviewed him if not.

Anyway, this rule is nothing to do with harrassing anybody. It's usually to make sure that you're not spreading rumours around about what's going on, and also to ensure that the employees are not passing any information on to you about the company or its activities that you have no right to know whilst you're not at work.

So the bottom line is, yes, she can legally tell you not to approach somebody (assuming that person is an employee of the company).

She has no legal right to bar you from speaking to anybody (even the police can't do that), only a magistrate or judge can as an individual has to take out a court order against another individual (get a restraining order, in newspaper-speak).

be very careful, your work friend may not be telling you the truth, before you do anything, get it in writing off him that he has never said you was harassing him.
if you take your firm to court and it turns out that he did say you was harassing him, it could end up costing you thousands.
ask to see the statement that this worker has made, if they refuse to let you see it, make a complaint in writing to the top man at your firm.
always ask for things in writing, don't just take there word for anything. good luck..xx

Suggest you call a meeting of all involved to sort this out without the need to take to court etc which won't do you any good in the long run. Be calm, write down all the points prior to the meeting etc

Other options are join a union and get advice from their rep.

If your friend was interviewed in relation to the investigatory and disciplinary meetings you had, then get your shop steward, if you have one in your work place, to ask to see these statements.

If the management refuse to let your shop steward to see these statements, ask the management, to show you the company policy, and whether it says your steward is not allowed to see these notes. Also get the management to document the fact that they have refused to show the statement.
