I had a friend get fired for insulting a manager on MySpace. It was on "private." Is this legal?


I've seen other questions answered where people got fired for this type of thing, but in this case I had sent my account to private. Isn't that a situation where it's not public information, and therefore not applicable?

WELL IF THE PERSON HAD MORE THAN ONE CO WORKER AS A FRIEND, I COULD SEE THAT HAPPENING EASILY. THAT'S WHY FOLKS HAVE TO BE CAREFUL WHAT INFO IS PUT OUT THERE. SORRY FOR THE CAPS!

someone must have seen it and forwarded it to the boss. It's irrelevant how the info was obtained if SOMEONE got to the site legally (was on the private viewing list). If someone got to that page and printed it out and showed it to the boss, how can your friend deny he did it? There have been warnings for a long term about being careful what you post on the internet. your friend wasn't being very smart

I don't think is legal to disrespect your boss if he has a way to find out

Yes, it's legal. It's absolutely stupid to write things in a public forum, such as MySpace, about a boss, co-workers etc.

Your off the clock behavior can legally be used to terminate you. Unless she/he had an employment contract stating otherwise.

Good lesson here. Don't put anything on MySpace you don't want everyone in the world to know or see.

In a "right to work state" you can be fired any time for any reason. What your friend did is as good as any reason to get fired.

Yes its legal, when you put things on the internet they are in the public domain even if they are "private" on myspace.

Yes it is legal, unless your friend works for the government. That was a pretty stupid thing to do on their part.

They didn't fire you because you based on race, religion, etc.

Anything else is 100% legal.

Nothing on the internet is "private" even if you mark it that way. Your employer can fire you for any reason or no reason in most states. Lesson learned.
