Can someone point me to the "new" law in California about lunch breaks.?


My employer is telling us that we must clock out for lunch after 4 hours by law. In the past we could work for 6 hours before taking a lunch. So, now folks that come in at 6am have to have lunch at 10am instead of say, 11:30.

I read somwhere that you can sign a document releasing the employer from future litigation about this type of stuff. Any links would be helpful.

Precaution. I beleive it still is 6 hours by law. An employer might force you to take your lunch at 4 hours because if you are indeed late to lunch your employer can get into serious trouble through the state of California.

There is no new law with respect to meal breaks in CA, although your employer may have implemented a new policy. You must take a meal period after 5 hours, unless 6 hours will complete your shift, in which case a meal period is not required.

It is indeed permissible for an employee to sign a waiver of meal periods if the employer permits an alternative schedule for meal breaks.

Visit www.dol.gov - find the "wage order" which pertains to your industry (retail, mining, hospitality, whatever) and then look for "meal and rest periods" if you want more detail about what the law requires. Good luck.

Yeah its the law. Im a supervisor for a grocery store and all employee must take a lunch if they are working more than 5 hours. So you must take a lunch at the fourth hour of your shift. I think you can go to calosha.ca.gov. Im not sure of the exact address but it has to do with osha regulations. I go on these websites when im a work to keep myself informed about the law and regulations
