Is it legal to deny my request to view my own time card?


During my last 2 pay periods I have felt that I haven't been getting paid correctly, I'm always short a couple of hours, so I started logging them. Last pay period, I should have been paid for 40 hours and was only paid 37! I asked my HR manager for a copy of my records and she said "The reports I run on ADP are designed for management use. "

How is this legal?? Is it?

Are there any Labor Laws I can look into to make her give them to me? I work in Woodland Hills, CA

That doesn't seem legal. You should have access to all of your employment files at all times. But, I'm not a lawyer so I can't say for sure.

You have the right to request to see a copy of your time card as well as your personal employee records. She is stupid and/or too lazy to print out you copies. GO over her head since she fails to comply. You can also call the board of labor and wages dept and file a complaint

Oh no, you do have the right to see your payroll records. Put the request in writing immediately, and document the response. I suggest you check out www.hrcalifornia.com for more information. You're in California... employees are (almost) always right!

I believe that you have a right to have your time at any given moment. It is yours just as your medical records are yours.

They didn't come out and say no you couldn't have it, they simply threw a road block in there to distract you.

By telling you that the reports run on ADP and are designed for management use, you were being warned, that if she pulled that for you, your boss would know.

I would go back and tell them you need a copy of your hours earned for the last month for a government form. They can not deny you that, they don't know you may be applying for a loan, for foodstamps, whatever. But they can not deny it.

I do payroll and use ADP, this is just a payroll company, you let them know what the employees work, and they issue the paychecks, any reports from ADP will say the same as your paystub, in otherwords, she brought up something totally irrelevant to skirt the issue, SHE MUST SHOW YOU YOUR TIMECARD IF YOU ARE NOT PAID THE HOURS YOU WROTE! When the roofers lie about their hours and the boss changes them, I make a copy of the altered time card and give it with their paychecks.

Your boss is full of crap on this.You need to seek the Labor board.You are in Calif. you can get some quick action.Don't take any crap.(On a lighter note,I won a car when I lived in Calif. and Woodland Hills Suzuki was where I picked it up.)Good luck on the pay problem.After you seek out The Labor Board,Your boss will start harrasing you,most likely.
