Legally, What can I do about my employer not paying me, all of my wages? |
I was not on the schedule,but I was suppose to work if I felt o.k.,after having a tooth pulled{i didn't get it done so i went in to do my shift,the other worker didn't leave}yes, business was slow, but we even stayed open an xtra hour,he said I was not gettingpaid because I wasn't on the schedule. I have a copy of my time card so I can prove I worked.what can I do?this is in ohio Go to the Department of Wage Labor and Hours. You'll have a check within 72 hrs. If he told you to come in if you were up to it and you have a time card that shows you were there, contract your HR Department, your Payroll Department or Labor Relations, I'll bet the money will be in your next check. Contact the local Labor Board in the town you are working. Usually in the city offices. If you have prof that you worked the hours and other employees that can vouch for you being there, this shouldn't be a problem. You worked it, you have proof you were there, he owes you $$ for that shift. Yes, he has to pay you, and what he is doing is illegal. Did you call ahead to let him know that you would be able to come in? You said you weren't on the schedule but were supposed to work if you felt OK - whether or not he owes you would depend on exactly what the agreement was between the two of you. You can take them to court by going to see a solicitor but this costs money- court costs ect. However you can see ADR which is resolving disputes before the courts if you go online and type in employment tribunal you will find all the necessay info you can fill out a form and they will contact you then your employer you will then go to a meeting. Abit like court but its alot cheaper sometimes it does not cost it is less formal and less intimidating. You can also seek mediation you can find all the details online. |
