What will the insurance company offer as settlement for my broken ankle? i am suing a homeowner's insurance


i play pro basketball in europe, asia and in south america. i make 6 figures playing ball throughout the year. i will miss all of my season in south america, and possibly in europe and asia because of possible surgery and rehab. how do insurance companies come up with settlement amounts? also because it is a break in the talus bone, it could cause long term damage. i do have experience on an nba roster. i was just cut

all info is in the person had missing steps in their home. the way i earned my living is in jeopardy because of someone not fixing their steps and not warning people abut their steps being unstable. its not my fault i was given a talent and i use it to earn a living. this is for the first person who answered. it has been determined that the homeowner was at fault because of the faulty steps as well as the city that passed the home for inspection

Maybe nothing.

A policy NEVER pays out more than the policy limit, so you're not likely looking at millions here. Plus, you're GOING to have to sue. If you haven't filed suit papers, you're certainly not going to get an offer.

Lastly, just because the accident happened on their premises, doesn't mean you're automatically entitled to something. You have to prove negligence. If, for example, you were jumping OVER those steps to show what a stud you are, you contributed to that injury - you're not going to collect. If they took reasonable precautions to prevent an injury on those steps - warning you about them, and/or putting up caution tape or another blockade, and you bypassed their precautions, you're not going to get anything.

If they have no homeowners insurance, likely the most you'll get is their house, complete with broken steps and mortgage.

You need to discuss this with your attorney.

I don't know but I am so glad that you get to make money off of your accident while I get to pay higher premiums to cover it.

Well, you're gonna have to provide evidence that the injury was due to the home owner's negligence, while the insurance company will argue that you were at least contributorily negligence if not wholly responsible. And they have lots of lawyers to drag it out.

I am really not sure that you will recieve much if anything for your injuries.

If you can prove you lost a 6 figure career due soley as a result of this particular injury, a small award may be plausible. You will find that the insurance companies will fight hard to prove that there was existing damage to the ankle do to the constant impact of running and jumping on it.

No offence, but I also inquire as to why someone making 6 figures a year, hasnt hired a really good lawyer of his own to provide more realistic answers and has resorted to polling the general public.

So....you were blind......your eyes did not function and you could not see the steps?

You hired a lawyer --- go ask him. You are going to be paying him a HUGE chunk of any settlement you get so make him earn it.

There is no guarantee they will make you an offer. They could take it to trial.
