Cancellation of health insurance due to work-related injury, is that legal? |
My employer claims that I did not work enough hours while I was out of work on worker' comp.....even when I do go back to work I have to wait for a year for the next enrollment with enough working hours to qualify again. Only if your primary carrier was used for a work-related injury that would have been covered by workers comp I don't believe so. Generally a work-related injury would be covered by a worker's compensation claim. But that should have no effect on your regular health care coverage. Was it canceled due to the injury or due to non-payment of the premium? I've seen that happen when people are out on workers' comp and don't realize that the employer is not going to keep paying the regular insurance premium while the employee is not working. its legal - check policy notes If you were out on a work related injury, your employer is not required to continue to pay for your health insurance. They ARE required to notify you that YOU can pay for your health insurance (COBRA). Your employer doesn't set the terms, their insurer does. This is a common problem with group policies.
