Injuray attorney for neck injury? need advice!?


the insurance wants to offer me a measly $1000. i lost work , didnt have insurance at the time, and so on. i went to freidman dominano and smith injury attorneys but they want 40% off the top, then to pay back the medical expenses that have already been paid from my new insurance, and then there fees for investigation. this sounds like there going to get most of my settlement. i just want what is FAIR. what do i do?

Most are going to want at least 30%, but you can get around that by paying them by the hour - usually $150, with a $5,000 retainer.

Anything you get from the at fault party, well, the "new insurance" gets first, for reimbursement. That's what's fair. If you want help, you either go to your agent for free help, or pay someone else, like a lawyer, that's fair.

How much is fair? Maybe nothing. There's not enough information here. How long were you disabled? How permanent were your injuries? What kinds of medical treatments/surgery/rehab did you have, for how long? How high were your medical bills?

If all you had was bumps & bruises and a sore neck for a week, well, $1,000 is MORE than fair.

You should shop around for your attorney. Look in the yellow pages and see who all is near you, and shop around to see what different prices are. Also, be sure to ask how much they think the settlement will be. 40% might sound like a lot, but if you get say, 250,000 from the settlement, and they take their 40%, you will still be left with around 125-150 grand, taking fees into consideration.
