Workmans comp question...impairment raiting...?


My husband got his impairment raiting from workmans comp today. We are from Texas and he got a 35 percent impairment raiting. He makes 1300 per week. Can anyone tell me how his settlement will be figured and when we should expect it now that he has just recieved his raiting?

Impairment ratings are based on several things, usually the ability to return to work, if there are permanent job restrictions or not, the body part and the percentage of disability awarded and the average weekly/monthly wage. Every state is different in their impairment calculations. The best thing to do is contact your adjuster, I would imagine there is some sort of award with the calculation on it outlining the payout. Also, these awards are usually paid out in monthly increments, and should start in a few weeks unless there is a dispute on the impairment rating by an interested party. The best thing to do is contact the adjuster, and your husband needs to do that not you. The adjuster has no obligation to discuss your husband's claim with you and may not. Then you will know exactly what your award will be.

Um, no. Workers comp doesn't pay for pain & suffering. How much did he make BEFORE the injury? How close is he to retirement age (65)? If his impairment is a permanent disability, the settlement is based on how many working years he has left, and how the impairment affects his ability to earn money in his current occupation.

Expect the settlement offer within two months, but it could easily take another six months until everyone agrees on something. Longer, if you have a lawyer.

This sounds like the other work comp question that had the same state and rating.

Your husband or yourself should ask the adjuster or you lawyer (if you have one) about this. How does the rating work into cash. Each state is different, such as Hawaii it's based on the maximum average weekly wage x the % of the rating.

In your state it could be different. So consult with either the adjuster or you lawyer. If you can't get a hold of either try calling the work comp division itself and perhaps they will tell you how it works.
