Life insurance claim? |
My partner of nine years past away while using a drug called ketamine. He never used drugs before but decided to experiment. I am wondering if I am going to have a problem collecting on the life insurance. I checked the policies and the only exception is "your suicide sane or insane within two years from the date of issue is a risk not covered" He has had the policies for almost five years and no where in the policies does it say anything about drugs or illegal activity. I had my insurance agent read over the policies and he said I would have no problem collecting but I wanted to get other opinions. In general, the life claims adjuster will look at the date of death, look at the policy issue date and if more than two years have passed, will cut a check for the death benefit. Once a policy is outside the contestability period there is no discussion of denying claims. Fighting over exclusions in life insurance cases is bad for business and erodes the underlying trust the general public has for insurance companies. I think your agent is correct, and probably the best person to answer your question. I haven't read the policy. I'm sorry for your loss. I don't foresee any problems with the claim process. Sorry gang but your info may not be correct. Most life policies have a clause that states if the insured dies by reasons known to cause harm they may not pay. It's a very grey area and usually they will investigate the coroner's report before they decide. Hopefully, the Ketamine in his system was not a lethal dose.
