My insurance got cancelled without them telling me. now i got stopped by police. what will happen to me? |
I got stopped by police, and they told me i had no insurance, i was shocked, because i genually thowt i had insurance, but they said my insurance company cancelled my policy. now i didnt get no notice of cancellation from the insurance company, so what will happen to me You firstly need to contact your insurance company to see why it was cancelled. They definitely should have at least written to you about it, companies don't generally cancel cover without notification. If it was due to the fact that perhaps your financial details had changed and they couldn't take payment then surely they would have contacted you or even written to you to say your policy had been cancelled. Did you move address during the year and not inform them? Motor insurance cannot generally be backdated though it is done in certain circumstances. Once you find out the reason for the cancellation and once there is a valid reason why you didn't know about, you should plead your case and presuming you have never being caught for anything like this before, you should be able to get away with a fine. Thereafter, you need to ensure that your financial details/contact details are kept up to date or perhaps call to the insurers to pay from now on to make sure it doesn't happen to you again. In some states if you car is not insured and you still have the tags they can suspend you license. Contest the ticket in court, bring evidence that showed that you paid your last insurance premium and tell them that you did not know that your policy had been canceled. Now, if you moved and didn't bother to let your agent know, then you probably didn't receive the paperwork...but it isn't your insurance company's responsibility to track you down. They send you notice that you're being cancelled, the effective date of the cancellation, and why you're being cancelled. Why did they cancel it? Did it run out or did you do something wrong or give them incorrect information, or not keep up monthly installments? I don't believe that didn't send you a notice. How did you pay the premium? If the insurance company returned your cheque or hasn't debited your credit card, then the presumption is that this fact alone should have made you aware of the fact they won't insure you. The first thing to do is to get proof from the insurance company that they obeyed the correct procedures to cancel your policy. This normally means that they must send you a letter by recorded delivery to your last know address advising you that the policy will be cancelled (check policy wordings). If they can't prove they did this then they didn't. (SOP - if it ain't written down it didn't happen). |
