there is no law for that. vacation is a privilege that most employers give as incentive. in the employee manual there should be a statement about accrued vacation. usually it is up to the supervisor to give the vacation pay or not. so if you leave on bad terms or get fired they legally don't have to give it to you.

It depends on the contract that you signed with the company upon agreement of employment. A lot of companies do not pay for unused vacation pay. Not necessarily. If you don't follow their termination process (eg. give them very short notice) they don't have to give it to you. Additionally, sometimes if you are fired, they have a clause in there that if you are fired, you don't get your vacation.
