Can my employer take money out of my paycheck for medical deductions they forget to previously take out?


I started with this company in May and took on the health insurance in September. My employer has just informed me that they have forgotten to take deductions from my paycheck each month for family health coverage but they have been paying this bill and I have been covered. They tell me I owe them $3,098.36 and are asking how I would like to pay this. They have now started to take the correct amount from my paycheck but say I owe them for the last three months. It was their mistake to forget to take it from my pay. Do I need to pay them this money?

Yes, it is legal for them to do this, your family was covered by the insurance, you requested they be covered by the insurance, you knew how much the cost to you was, and you knew the amount was not being deducted from your paychecks and did not speak up and let them know. You need to make payment arrangements to get this past due amount paid back to them as soon as possible.

This is 3/10 of 1% of the standard coverage cap. Would you be asking this question if you were hospitalized and needed that million dollars?
